Terms & Conditions

In working with Food Truck League NZ Ltd you agree to the following terms and conditions.

1. Definitions

  • “FTL” means Food Truck League NZ Ltd.
  • “Vendor” means any independent food truck, trailer, or food provider providing catering or service through FTL.
  • “Client” means any individual, organisation, or event organiser engaging vendors through FTL.

2. Client Obligations & Pricing

  • Clients agree to pay all accounts on or before the due date as indicated on supplied invoices.
  • Late payment incurs an additional fee of 2% or $10 per month (whichever is greater).
  • Catering requests less than 6 months from invoice date: Full payment is required to confirm and secure the truck.
  • Catering requests more than 6 months from invoice date: A 50% deposit secures the truck. The remaining 50% must be paid at least 14 days prior to the event.
  • Event catering (public pays the truck directly): The client agrees to pay a non-refundable booking fee of $100 incl GST per truck, and guarantees at least $1,250 worth of gross sales per truck, per day.
  • Minimum Guarantee Mechanics: If a vendor only achieves $1,000 incl GST in public sales, the client pays the remaining $250 incl GST balance directly at the conclusion of service. For multi-vendor events, the guarantee is collective across all trucks (e.g. 3 trucks require $3,750 incl GST in combined sales), ensuring the client is not penalised by individual truck popularity variances.
  • Payment via credit card incurs a 2.9% transaction fee.

3. Site Access & Power Requirements

  • Ground & Access: The client is responsible for ensuring clear, unimpeded vehicle access, adequate overhead clearance (minimum 3.5m), and a flat, level, solid parking surface (concrete, asphalt, or dry compact ground). Food trucks cannot operate on waterlogged grass or steep gradients.
  • Power Supply: The client must confirm power availability prior to the event (specifying standard 10A, 16A caravan sockets, or 32A 3-phase). If venue power is unavailable or insufficient, FTL must be notified so vendors can arrange certified silent/inverter generators (additional hire costs may apply).

4. Permits & Council Consents

  • The client or event organiser holds sole responsibility for obtaining all landowner permissions, private venue approvals, council public trading permits, or traffic management plans required for the event location.
  • Any fines, trading halts, or council enforcement action arising from missing site permits will be the sole liability of the client, and full catering/guarantee balances remain payable.

5. Dietary Requirements & Allergies

  • While vendors make every reasonable effort to accommodate dietary preferences (gluten-free, dairy-free, vegetarian, vegan), all food is prepared within compact mobile commercial kitchens.
  • FTL and its independent vendors cannot guarantee a 100% allergen-free or cross-contamination-free environment. Neither FTL nor the vendors accept legal liability for adverse allergic reactions.

6. Waste Management & Bins

  • Vendors are responsible for cleaning their immediate cooking footprint and removing their back-of-house kitchen waste and cooking oils.
  • The client is strictly responsible for providing, monitoring, and disposing of front-of-house guest rubbish bins, recycling stations, and post-event grounds cleanup.

7. Mechanical Breakdown & Force Majeure

  • Breakdown / Transit Issues: In the rare event of mechanical failure, road closure, traffic collision, or sudden vendor emergency, FTL will make every reasonable effort to dispatch a comparable replacement truck.
  • If a replacement truck cannot be secured, FTL's liability is strictly limited to a full refund of any fees paid for that specific truck's service. FTL holds no liability for consequential loss.
  • Force Majeure: Neither party shall be liable for failure to perform duties due to acts of God, extreme severe weather events, national emergencies, or civil disruptions beyond reasonable control.

8. Changes, Cancellations & Refunds

  • Change Fees: Requests to change dates, service times, or agreed menus after confirmation are subject to vendor capacity and discretion. Changes requested within 21 days incur a 50% change fee in addition to event catering fees.
  • Catering Cancellation within 7 days of event: 0% refund.
  • Catering Cancellation between 7 and 20 days: 50% cancellation fee applies.
  • Catering Cancellation 21+ days from event: 50% cancellation fee applies.
  • Bad weather cancellations fall under the standard catering cancellation schedule above.
  • Public Event Service Cancellation within 21 days: The client must pay the $100 incl GST booking fee per truck and the $1,250 incl GST minimum guarantee per truck per day (plus any perishable supplier ingredients pre-purchased exceeding this amount, backed by supplier receipts).

9. Vendor Obligations

  • Vendors agree to complete accuracy and transparency in all post-service sales reporting.
  • Vendors agree to remit all commissions, fees, and invoice balances to FTL on schedule.
  • Vendors unable to attend an event must inform FTL immediately and refund any deposits within 3 business days.

FTL reserves the right to amend these Terms & Conditions at any time.
